It was released intact on the GBA in Japan in recent years and rated by the ESRB for a North American release last year, indicating it's in the pipeline for an eventual release. So I wouldn't be so sure.
Alleged copyright issues scaring away Nintendo of America from releasing it has largely been popularized by one website that has never revealed it's sources, and many of their claims of copyright violations due to similarities to such things as in-game sound samples are slim at best when compared.
Still, companies are terrified of possibly violating copyright laws so it could just as easily be correct.

There is some exciting news in Japan with the vc that could affect North America and Europe down the road.
There will be two Neo Geo vc game releases in November in Japan. The games are Fatal Fury Special (November 4th - An enhanced version of Fatal Fury 2) and Choutetsu Brikinger (A very rare, yet very fun shoot 'em up, which was planned for North American release as Ironclad, but never came out. It's also the first Neo Geo CD game on Virtual Console!)

Fighting Street was released on Capcom Classics Collection Volume 2 for the PS 2 and the Xbox as Street Fighter 1. Street Fighter was no where as good as its sequel. I never played the turbo CD version of the game before and I have bad feeling about it since it only was a 2 button game for the system unlike Street Fighter 2: Champion Edition for the Pc-Engine. Street Fighter 2: Champion Edition was able to be played on a 6 button controller called Avenue Pad 6.
I own the Sms version of R-type. There are differences between the sms and the Tg-16 version that already was released. The extra level was one of the differences. The other differences is the Sms version is easier than the Tg-16 version and the graphics are better on the tg-16. The graphic difference should be expected since the sms isn't as powerful as a tg-16.. The Sms version is a very good version though.
R-Type is badass. I'm going to be playing that one very, very soon.

Wonder Boy III: The Dragon's Trap was already released on the vc as Dragon's Course for the Tg-16. The differences between the two versions is the graphics are better on the Tg-16 and the Sms version uses a password system instead giving you the option to save the game. The Sms version is 100 wii points less to download.
Wonder Boy III: The Dragon's Trap is one the best games that I own for the Sega Master imo.
The C64 got it's 9th vc release today. North America is now 10 vc game releases away from the amount Europe has.

I am still kinda sad that they have no plans what so ever of bringing the entire classic gameboy (incl. Color & SP) to the DSiWare... That was my main reason of purchasing my DSi...
